This disclosure is intended to satisfy the requirement set out in paragraph 17 of the GCF Policy and paragraph 65 of the GCF Revised Environmental and Social Policy to disclose an ESIA and ESMP, at least 30 days in advance of the Accredited Entity’s investment decision.

The Engineering, Procurement and Construction (EPC) and Operations and Maintenance (O&M) Contractors must develop an Environmental Management System that is commensurate with the nature and scale of the project, that is in line with the EA, EMPr and ESMS framework set out by the Borrower. The LTA will review the ESMS during the construction and operations phase site visits to see how the plan is implemented on site.

The public participation process for the proposed Wind Energy Facility (WEF) followed the requirements of the NEMA EIA Regulations (2014, as amended) and was conducted over distinct phases: the Application Phase, the release of the Basic Assessment Report (BAR), and the Part 2 Amendment.

1. Application Phase: Notification of adjacent landowners and occupiers commenced on 23 August 2021, with a 30-day comment period ending on 21 September 2021.  Site notice boards (minimum dimensions 60cm x 42cm, in English) were erected at strategic and visible locations along the project site boundary.  Newspaper advertisements were placed in the Langeberg Bulletin (local) and Cape Argus (provincial). The draft BAR was shared with registered stakeholders via an online platform (OneDrive). A stakeholder database compliant with Regulation 42 was compiled. All comments received during the public comment period were documented and responded to in the Comments and Responses Report (CRR) appended to the BAR.

 

2. Release of Final Basic Assessment Report (BAR): Registered stakeholders were informed via email of the availability of the Final BAR. The comment period ran from 04 October 2021 to 02 November 2021. The Final BAR was provided through a secure online link. For stakeholders who could not access the digital version, hard copies or CDs were made available upon request. The process was confirmed by the Environmental Assessment Practitioner (EAP) to be compliant with the NEMA EIA regulations.

 

3. Part 2 Amendment (2024): The Part 2 Amendment was advertised to run from 02 September to 02 October 2024. The I&AP database from the 2021 BAR and the 2023 withdrawn amendment application was used, updated, and verified for this process. Site notices (60cm x 42cm, in English) were erected at visible boundary locations of the WEF site. A public notice was published in the Langeberg Bulletin. The Draft Motivation Report and annexures were shared via a secure online link. All comments received were captured in a Comments and Responses Report (CRR), included with the Final Motivation Report submitted for decision.

 

Across all three phases, the public participation processes have adhered to statutory requirements and ensured transparent and meaningful engagement with stakeholders, with comments and/or concerns being duly considered by the EAP.

The project was thus approved by the South African Competent Authority – refer to section 14 of Basic Assessment Report.

Provision on disclosure at subproject level

Clause 11.02 (k): 

In relation to each Sub-Project that is category B (pursuant to the Environmental and Social Risk Categories), disclose the ESIA and ESMP and, as appropriate, inclusive of the Land Acquisition and/or Resettlement Action Plan (“LARAP”) and any other associated information including those relevant to indigenous peoples required to be disclosed pursuant to the Information Disclosure Policy and the Environmental and Social Policy (each, the ”Sub-Project Disclosure Package”). The Accredited Entity shall disclose the Project Disclosure Package at least thirty (30) calendar days prior to its approval of the relevant category B Sub-Project, in English and in the local language (if not English), on its website and in locations convenient to the affected peoples, and submit the Sub-Project Disclosure Package to the Fund for subsequent distribution to the GCF Board and the Fund’s active observers and for publishing in the GCF website.
